CE, FCC, RoHS: Product Compliance Basics for Importers

Compliance marks are the part of importing where a misunderstanding becomes a seized shipment or a recall. CE, FCC, and RoHS are routinely treated as three stickers a Chinese supplier applies before packing, when in law they are three different regimes with different scopes, different conformity routes, and one common feature: the party legally on the hook in the destination market is usually you, the importer. This guide explains how CE self-declaration differs from notified body involvement, the FCC's SDoC and certification paths, what RoHS and REACH actually restrict, and how to check whether a test report is real.

Who Is Responsible: The Importer, Not the Factory

Under the EU's market surveillance framework and product directives, economic operators along the chain carry defined obligations, and the importer placing a product on the EU market must ensure the manufacturer has carried out the correct conformity assessment, that technical documentation exists, and that the product bears required markings and traceability information. In the United States, FCC equipment authorization rules similarly attach responsibility to the responsible party, which for imported consumer goods is typically the importer or the brand owner, and the SDoC route explicitly requires a responsible party located in the US. The practical meaning is blunt: a certificate PDF from your supplier does not transfer legal responsibility. When a market surveillance authority in Hamburg or a customs officer in Los Angeles finds a problem, the letter goes to the importer of record. Budget compliance as your own project with the supplier as a data source, not as the owner.

CE Marking: Self-Declaration Versus Notified Bodies

What CE actually is

CE marking is the manufacturer's declaration that a product meets all applicable EU directives and regulations, such as the Low Voltage Directive 2014/35/EU, the EMC Directive 2014/30/EU, the Radio Equipment Directive 2014/53/EU, the Machinery Directive 2006/42/EC (being succeeded by the Machinery Regulation (EU) 2023/1230), and the Toy Safety Directive. There is no CE certificate issued by the EU and no such thing as a CE approval body for most products. The core deliverables are a technical file, test evidence against harmonized standards, and an EU Declaration of Conformity signed by the manufacturer or its authorized representative, naming the directives and standards applied.

When a notified body enters

Most electronics and machinery follow the self-declaration route, where the manufacturer, in practice supported by the importer, compiles testing and signs the declaration. Higher-risk categories, defined within each directive, require a notified body: an EU-designated conformity assessment organization with a four-digit identification number, listed in the European Commission's NANDO database. Examples include certain machinery in the directive's high-risk annex, most personal protective equipment categories, medical devices, and some radio equipment paths. Two red flags follow directly. If a supplier shows a CE certificate from a body whose number does not exist in NANDO, or applies a notified body number to a product category where none is required, you are looking at decoration, not conformity. And a CE mark subtly redesigned with squeezed letter spacing has historically circulated as an unofficial export marking; the geometry of the genuine mark is defined in the regulations.

FCC: SDoC and Certification

The FCC regulates electromagnetic emissions and radio transmitters under Title 47 of the US code, most relevantly Part 15. Since the 2017 consolidation, two routes exist. Supplier's Declaration of Conformity (SDoC) covers unintentional radiators, meaning ordinary digital electronics that do not deliberately transmit: the device is tested at a lab, the responsible US party keeps the evidence and is identified with the product, and no FCC filing is made. Certification is mandatory for intentional radiators, meaning anything with WiFi, Bluetooth, cellular, or other radio functions: testing must be done at an FCC-recognized accredited lab, the application goes through a Telecommunication Certification Body, and the device receives an FCC ID that must appear on the label and is searchable in the FCC's public equipment authorization database. The practical shortcuts and their risks are well known: reusing another product's FCC ID, or relying on a module's certification while modifying antennas or layout beyond what the module grant allows, both invalidate the authorization. If your product contains a certified radio module, obtain the module's grant conditions and confirm your integration respects them, and confirm the FCC ID on the label resolves to the correct grantee in the database.

RoHS and REACH: Different Laws Doing Different Jobs

RoHS, Directive 2011/65/EU as amended by Delegated Directive (EU) 2015/863, restricts ten substance groups in electrical and electronic equipment: lead, mercury, cadmium, hexavalent chromium, two brominated flame retardant families, and four phthalates, each with maximum concentration values assessed at the homogeneous material level. RoHS compliance is part of CE marking for electrical products, so it rides on the same declaration and technical file. REACH, Regulation (EC) 1907/2006, is not an electronics law at all: it governs chemicals across nearly all products, and for importers of articles the operative duties revolve around the Candidate List of substances of very high concern (SVHC), which is updated regularly. Cross a concentration threshold of a listed substance in an article and you owe customer communication and possibly notification duties, and articles containing SVHCs must be reported into the EU's SCIP database. The sourcing consequence: RoHS is verified with material screening, typically XRF screening backed by wet chemistry on suspect materials, and supplier declarations per component, while REACH requires an ongoing declaration process because the SVHC list grows every year. A supplier statement dated three years ago is stale by definition.

Verifying Test Reports

Fabricated and recycled test reports are a persistent feature of the export trade, and verification is cheaper than discovery at customs. Work through four checks. First, the lab: legitimate reports come from laboratories accredited to ISO/IEC 17025 by a recognized accreditation body, such as CNAS in China, and the accreditation certificate number printed on the report can be checked on the accreditation body's public register; accreditation bodies in the ILAC mutual recognition arrangement give the report international standing. International groups such as SGS, TUV, and Bureau Veritas operate verification portals where a report number can be checked against their systems, which defeats the common tactic of editing a real report's product name. Second, the sample: the report describes a specific model, ratings, and photographs; compare them to your actual product, because a report for a sibling model with a different power supply proves nothing. Third, the standards and dates: check that the harmonized standard editions cited are current for the directive claimed and that the report predates neither the product design nor plausibly the company's founding. Fourth, the chain: for FCC certification look up the FCC ID in the public database; for notified body certificates check NANDO.
